If it was knowingly missold it's criminal, at least under the laws of the UK. Seriously doubt anyone will, if there is legal action it'd be one big operation vs another, Spotify vs Sony for example. But the value in these little celebrated tracks might be hard to prove. The one thing I think is nailed on is the unavailability of anyone there at the time to confirm, deny whether they used a sound-a-like. Nobody will want to have been responsible, if they find someone who was, that person is likely unable to escape the evidence trail and was probably ordered by someone higher who can escape it.
